Barring some great turnaround or GOP implosion I don't think Obama has much chance in 2012 regardless, but ignoring that, this is by far the best piece I've read about why Khalid Sheik Mohammed should not be granted a trial.

Are we at war – or not?

For if we are at war, why is Khalid Sheikh Mohammed headed for trial in federal court in the Southern District of New York? Why is he entitled to a presumption of innocence and all of the constitutional protections of a U.S. citizen?

Is it possible we have done an injustice to this man by keeping him locked up all these years without trial? For that is what this trial implies – that he may not be guilty.

And if we must prove beyond a reasonable doubt that KSM was complicit in mass murder, by what right do we send Predators and Special Forces to kill his al-Qaida comrades wherever we find them? For none of them has been granted a fair trial.

When the Justice Department sets up a task force to wage war on a crime organization like the Mafia or MS-13, no U.S. official has a right to shoot Mafia or gang members on sight. No one has a right to bomb their homes. No one has a right to regard the possible death of their wives and children in an attack as acceptable collateral damage. Absolutely, not in itself but this will be a big part. I loved in an interview today when asked about it. Obama said that KSM would be found guilty and put to death. The interviewer then asked if this was the case why bring him to NY and go through all of this when a military trial would get the same result without the cost to NY and risk. Obama couldn't give a good answer but we know it's a show trial and just another jab at Bush and Cheney. It's old, played out and petty but now he has created a huge media circus that could degenrate into a huge mess. By far the worst decision to date by Obama and this will dog him.

This is undeniably one of the worst decisions made by a U.S President. Even his base is shaking their head over this one. For a little bit I thought it was a good idea to put them on trial in NYC...let the city they attacked have its revenge but the reality is this is a matter for a military trail. Its an insult to the American people that we are giving them the same rights all of us work for and earn. We are simply handing these pigs the same rights we enjoy.

This is a turning point for me; Holder and Obama have crossed a line, a foolish line they didn't have to cross. Hubris and I am afraid its a bad judgment. The Buchanan article touches many reasons and there are still more besides. They've unnecessarily put themselves and us in a bad position.

Here's hoping Soccer Mom is not the next GOP candidate, or I will not be voting at all....

I hope she's not either Tom, I think the GOP is smarter then that. We need someone who's in the center, we can't have these extremes anymore. We went from Bush who was far right to Obama who's far left...these swings just don't work for the country. However I don't see any rising stars in the GOPs corner right now. Hind sight is 20/20 but I really do think Clinton would have made a far better leader then Obama. I generally don't regret many things in life but I do regret voting for him..I should have stuck to my original plan of not voting in 08.

Senator Clinton would have not fared any better, not even sure how good Senator McCain would have been, but, either would have been better than President Obama.

The problem you are seeing is what happens when a politican enters the White House, they lack leadership skills. The only saving grace with Senator McCain is that he had a military background......

Senator Clinton has no leadership skills & slight more than 1 term in the Senate, the rest of her experience was her tenure as First Lady, where she spent most of her time drinking tea & baking cookies....

I'm for the trial. If KSM is being tried strictly for the World Trade Center and Pennsylvania then it's a federal and civil matter. If it's for the Pentagon and/or the USS Cole, then yes, they need to be tried by a military court. To be honest the only difference between Ramsay Yusef and KSM is that Yusef's bomb wasn't powerful enough. The intent and loss of life were still achieved and he was tried by a civilian court and found guilty.
