The Court of Appeals for the Second Circuit handed down their decision this morning in Air Transport Association of America v. Cuomo, ruling that since the airline industry is already obliged to obey the Federal Airline Deregulation act, the state may not create a law which supersedes it. The supremacy clause of the Constitution bars states from legislating in areas already covered by Federal statutes.
